XRP tožba: Tudi če Ripple zmaga pri tem predlogu, to ne bo pomenilo ...

Minilo je že več kot 171 dni, odkar se je ameriška komisija za vrednostne papirje in borze odkrito soočila z XRP in Ripple Labs, tako da je proti njima sprožila tožbo. Do danes so izmenjali številne predloge in memorandume, vendar ni jasnega zmagovalca. Ta primer je po svoje edinstven in morda brez primere, vsaka sodna odločba pa je imela in bo imela svoje daljnosežne posledice. 

For starters, the SEC’s resolution to seek legal advice documents from Ripple has evidently zaleden on them. They had outrightly blamed the blockchain firm for “ignoring” the legal advice they had received, and post the court ruling, they lost their prime argument against the defendants’ fair notice defense. 

Ripple, on the other hand, has already presented two crucial defenses and has been tackling the SEC’s blame game quite rigorously. The SEC demanding additional witnesses for discovery was retaliated against by Ripple by accusing the agency of “spreminja svojo melodijo.” Additionally, the San Francisco-based blockchain firm also pointed out the fact that it is facing an “existential threat” from the SEC’s discovery extension request.

The SEC, for its part, has had a flawed run at the case, according to many. Even after receiving stalne zahteve to produce BTC, ETH, and XRP-related documents, it has only been turning a blind eye towards the same. Ripple, on the other hand, has complied with almost all the requests put forth by the agency. All in all, it would be fair to argue that the SEC has already received more than what it had asked, but is still extending its arms further. 

After time and again attacking Ripple’s crucial fair notice defense, the SEC had recently claimed that the same fails as a matter of law. The most relevant question now remains, would the SEC look back at its actions as a mistake if the defendants end up winning this particular motion?

"Pričakujem, da bo Ripple / def premagal možnost SEC, da zavrne obrambo poštenega obvestila ..."

Odvetnik je prav tako hitro poudaril, da je treba njegovo mnenje sprejeti s ščepcem soli, ker bi se sodba morda lahko obrnila tudi v drugo smer. Če pa bo obramba poštenega obvestila razglašena v korist Rippleja, lahko to vodi tudi do tega, da se tekoči primer poravna ali reši še pred skrajšanim zaslišanjem. 

Ergo, as popular attorney Jeremy Hogan had previously navedla, the future of the lawsuit depends on this “main” defense and Ripple has successfully been able to “apply pressure” on the SEC.

Skupnost je bila pozno proti temu, da bi Ripple rešil primer. Eno bi pomenilo "nepošten" precedens, drugo pa bi pomenilo, da podjetje podleže SEC. V Hynesu mnenje, Ripple naj nadaljuje samo od tu, namesto da bi se oziral nazaj in popuščal. 

On the contrary, it is known that Ripple is set to go javnega after the conclusion of the case. Keeping that in mind, it would definitely not want to “destroy” the SEC and hence, the settlement option cannot be completely ruled out at this stage.

Čeprav ni zelo očitno, katera stranka ima prednost, ne bi bilo napačno trditi, da nihalo niha vsaj v korist podjetja blockchain. Vendar je treba opozoriti, da tudi če Ripple uspe dobiti predlog za pravično odpoved, to ne zagotavlja zmage med preizkusom. Pojasnim isto, Hynes dodano, 

»Zmaga po tem predlogu ne pomeni, da bo obramba zmagala na sojenju. Preprosto je, da je to mogoče trditi na sojenju. Zmaga v tem predlogu ni pokazatelj, da se bo sodnik postavil na stran te obrambe, ko gre za razpravo o zadevi. "
