Binance se confruntă cu o luptă juridică în timp ce autoritatea de reglementare din SUA se pregătește să zboare

Este un lucru rar atunci când purtătorii de cuvânt ale corporațiilor spun multe care ar putea fi considerate interesante, darămite revelatoare. Cu toate acestea, tocmai asta au făcut oamenii din domeniul comunicațiilor de la Binance în urma știrii că cel mai mare schimb de criptomonede din lume este dat în judecată pentru presupusa încălcare a legii SUA.

Într-o declarație de răspuns la procesul pe care Comisia pentru tranzacții și futures pe mărfuri din SUA l-a intentat împotriva lui Binance și a cofondatorului său, Changpeng „CZ” Zhao, pentru presupusele încălcări ale Legii bursei de mărfuri și ale regulamentelor CFTC, compania a cerut dezvoltarea unui „regim de reglementare clar, atent.”

Până acum, atât de bland, nu? Poate. Dar în cea mai litigioasă țară din lume, legea nu trebuie să fie clară. Și când vine vorba de finanțare în țara celor mai profunde și lichide piețe de capital din lume, lucrurile nu devin mult mai clare decât regulile și reglementările. 

Și, după cum se întâmplă, acest lucru vine în aceeași săptămână în care o altă agenție din SUA, Securities and Exchange Commission, a depus o notificare Wells către schimbul de criptomonede Coinbase, semnalând că urmează măsuri de aplicare. Coinbase este apoplectic, iar frustrarea sa este rezumată pur și simplu într-un tweet postat de directorul său juridic, Paul Grewal, care a spus: „După ani de zile în care am cerut reguli rezonabile pentru cripto, suntem dezamăgiți că SEC ia în considerare instanțe în detrimentul unui dialog constructiv. .”    

Apelul Binance pentru claritate în materie de reglementare este incontestabil, la fel ca și cel al Coinbase, și este reprezentativ pentru o viziune împărtășită în restul industriei cripto, în timp ce se luptă să iasă din umbra crizelor și exploziilor traumatice de anul trecut. 

Indiferent dacă acuzațiile CFTC sunt valabile sau nu, Binance are o istorie plină de culoare când vine vorba de reglementare și conformitate. Cu toate acestea, mișcarea bursei de la sfârșitul anului trecut de a înființa un fond de recuperare pentru activele cripto în dificultate – disputele cu privire la dimensiunea sa la o parte – a fost un gest admirabil care părea să semnaleze o nouă hotărâre din partea sa de a merge pe partea corectă a lucrurilor. La fel cum a fost și anunțul Binance vara trecută că va stabili un sediu global și o structură de management transparentă și profesională. 

Dar poate că toate acestea au fost mișcări bine planificate pentru a contracara potențialele pași greșiți anterioare în acest joc de șah reglementat. Și asta continuă să se desfășoare. Au căzut multe bucăți. În urma enormului sentiment de trădare cu care industria cripto a fost înșușată de colegul cripto-rege Sam Bankman-Fried, acțiunile CFTC și SEC din această săptămână au apărut un vânt politic din coadă.   

Dar până când ciocănul judecătorului cade, se pare că industria cripto-ului este pregătită pentru încă mai multă căutare sufletească, deoarece caută un teren mai solid. Pe plan internațional, autoritățile de reglementare iau în considerare și ele. Acest joc de șah este unul global și așteptăm următoarea mișcare.

Changpeng Zhao described the filing of a lawsuit by the CFTC against Binance as “neaşteptat,” but the regulator has been probing his crypto exchange since 2021. 

The CFTC has been investigating whether Binance has sufficient measures in place to keep U.S. residents from buying and selling crypto derivatives. CFTC rules generally require platforms to register with it if they let Americans trade such products. Binance has, for years, seemed unwilling to comply, and the CFTC says the exchange has made millions of dollars by doing so. 

The regulator has also accused Binance of not doing enough to combat money laundering. According to CFTC’s complaint, since at least last May, Binance had not filed a single suspicious activity report in the U.S. For an industry in which such activity is rife, it seems odd that the world’s biggest exchange wouldn’t have been a conduit for at least some shady money.  

The CFTC can’t bring criminal charges against firms or seek jail time for individuals, but it can further damage the reputation of an exchange that has thus far managed to shrug off a lot of procese precum și consternation by other regulators.

But thanks to the persistent efforts of law enforcement agencies, that narrative is now changing. One part of the history being rewritten concerns the role FTX and affiliated companies may have played in breaking the Terra-Luna relationship for profit. 

The other, and the reason for Do Kwon’s arrest, is how he and others allegedly managed to siphon billions of dollars from investors while propping up liquidity, in addition to developers’ apparent concealment of vulnerabilities in the project’s code.

Crypto’s speculative nature and enormous energy consumption — not to mention its ability to move large amounts of money outside of government control and monitoring —  made China sufficiently nervous to ban all crypto mining and crypto transactions in September 2021. However, Chinese authorities now appear to see the upside of crypto development, with Hong Kong publishing a series of policy documents to oversee the growth of the crypto sector in the city.

Now that Chinese state-owned banks are voicing support for a growing number of crypto firms in need of corporate bank accounts, startups in the city may gain easier access to banking services. The Chinese banks’ moves could fill the void left by the collapses of crypto-friendly U.S. banks Banca Silicon Valley, Capitala Silvergate și Banca de semnături.

Chinese officials, including representatives from China’s Hong Kong Liaison Office — Beijing’s representative outpost in the city — have been spotted mingling with local crypto industry figures at events in Hong Kong, Bloomberg raportate last month, another sign that Beijing has given its blessing to Hong Kong’s crypto push.

It’s becoming increasingly clear that China intends to develop its Web 3.0 industry, deploying all kinds of enterprise blockchain and government infrastructure projects while confining all things crypto to Hong Kong, a special administrative region that runs its own economy according to free market principles. As Hong Kong’s noul regim de autorizare for virtual asset trading platforms comes into effect later this year, the city may find itself in the enviable position of returning to its former glory as a crypto hub while underscoring assurances to investors and company founders that Hong Kong’s political overlords will not interfere.
